A federal appeals court recently made a decision regarding Hunter Biden’s attempt to dismiss the pending criminal gun case against him. The court ruled that the appeal was premature and cleared the way for the trial to proceed on June 3 in U.S. District Court in Delaware. This ruling comes as a blow to Hunter Biden, who is the son of President Joe Biden. The three-judge panel on the 3rd Circuit U.S. Court of Appeals unanimously decided that Hunter Biden failed to show that the trial judge’s decision allowing the case to move forward was appealable before a final judgment was reached, which could include his sentencing.
Hunter Biden’s lawyer, Abbe Lowell, indicated that they may seek further review of the decision by asking a full panel of judges on the 3rd Circuit to reconsider the appeal. There is even a possibility of appealing to the U.S. Supreme Court to consider the case. Despite the setback, Hunter Biden maintains his innocence and has pleaded not guilty to the three criminal counts related to his purchase of a handgun while he was allegedly addicted to illegal drugs.
In late 2023, Hunter Biden’s legal team raised three main arguments to have the indictment dismissed. Firstly, they claimed that the indictment violated a non-prosecution provision in a pretrial diversion agreement that Hunter Biden and prosecutors had signed before an intended deal in the case fell through. Secondly, they argued that the prosecution was motivated by a political agenda, suggesting that Hunter Biden was selectively targeted due to his father’s position as the president. Lastly, they contended that the appointment of David Weiss as special counsel for the Department of Justice was in violation of federal rules, as he was already a U.S. Attorney for Delaware when he was appointed.
In addition to the pending gun case, Hunter Biden is also facing tax crime charges in Los Angeles federal court, brought against him by David Weiss. The judge in that case recently denied eight defense motions to dismiss the charges, and Hunter Biden maintains his innocence in that case as well. The legal battles Hunter Biden is currently facing have drawn significant attention due to his familial connection to the President of the United States.
The rejection of Hunter Biden’s appeal by the federal appeals court marks a significant development in his ongoing legal troubles.
