An emergency plan set in motion to avoid overcrowding in prisons, known as Operation Early Dawn, is anticipated to be enacted today. The operation entails the detention of defendants awaiting a court appearance in prison cells for extended periods if there is a lack of space in jails in the event they are remanded in custody. This plan is likely to begin on Monday morning, causing potential delays or adjournments of court dates at short notice.
With the recent riots in the UK leading to numerous arrests and charges, the prison system is under immense pressure. The Prison Officers’ Association Chairman, Mark Fairhurst, predicts that Operation Early Dawn will be activated due to the shortage of spaces. This plan acts as a triage system for prisoners held in police cells, ensuring that only the most serious offenders will be taken to court when there is a guarantee of a prison cell for them.
Particular regions, such as the North East and North West, are facing significant challenges due to overcrowding. Offenders in these areas might have to be transported far away from home to serve their sentences, highlighting the strain on the prison estate. The Ministry of Justice acknowledges the concerning levels of violence and self-harm in prisons, which are exacerbated by overcrowding and the lack of resources.
To address the overcrowding crisis, Justice Secretary Shabana Mahmood plans to temporarily reduce the portion of a sentence that must be served before parole eligibility from 50% to 40%. This initiative is expected to lead to the release of 5,500 individuals in September and October. However, certain offenders, including those convicted of terrorism, sex offenses, domestic abuse, and specific violent crimes, will not be eligible for this scheme, neither will individuals involved in the recent riots.
Operation Early Dawn was previously implemented in May under the previous government to alleviate overcrowding in prisons. The Law Society expressed concerns about the potential delays in cases and the uncertainty faced by solicitors regarding their clients’ court appearances. The Ministry of Justice reaffirms its commitment to ensuring sufficient prison spaces and swift justice for criminals who break the law.
The activation of Operation Early Dawn underscores the challenges faced by the UK prison system in managing overcrowding and maintaining order. The government’s actions to address this crisis, including the temporary release of prisoners and the adjustment of parole eligibility, aim to ease the burden on prisons while ensuring that justice is served.
