The federal gun case against Hunter Biden, the president’s son, is set to go to trial in June according to U.S. District Judge Maryellen Noreika. The trial, tentatively scheduled for the week of June 3, is expected to last approximately nine days. This includes one to two days for jury selection, three to five days for the prosecution to present its case, and one to two days for the defense to present their arguments. The charges against Biden include three counts related to the possession of a gun while using narcotics, with two of the counts carrying maximum prison sentences of 10 years and the third carrying a maximum sentence of five years.

Hunter Biden has pleaded not guilty to the charges and his attorney, Abbe Lowell, has filed several motions to dismiss the case, all of which are currently pending. The issue of scheduling conflicts has arisen, as there is a scheduled status conference for the federal tax case against Biden in California on the same day that the gun case trial is set to begin. Prosecutors have indicated that the tax case could potentially last several weeks, extending into mid or late July, posing a challenge for the overlapping of the two trials.
Plea Agreement and Falling Apart
There was a plea agreement reached between prosecutors and Biden’s attorneys in July of last year that aimed to resolve both the gun and tax cases. The agreement involved Biden pleading guilty to two misdemeanor tax evasion charges and the felony gun charge being dropped after two years if Biden complied with the terms of the diversion agreement. However, the plea agreement fell apart after Judge Noreika raised concerns about some provisions, particularly one that could have shielded Biden from being charged with other tax-related crimes during the same time period. As a result, Biden has maintained his not guilty plea in the California tax case and his legal team has sought to have those charges dismissed as well.
